Terms of Carriage

BALLITO MICROLIGHT ACADEMY (T/A BALLITO MICROLIGHTS) TERMS & CONDITIONS OF BOOKING & CARRIAGE

1. DEFINITIONS

Wherever used in these terms and conditions: (a) “We,” “Us,” or “Our” refers to Ballito Microlights (BMA). (b) “You,” “Your,” or “Passenger” refers to the customer or passenger. (c) “BMA” refers to Ballito Microlight Academy.

By purchasing a BMA flight, you acknowledge that you have read and accepted these terms and conditions.

2. GENERAL TERMS

  1. BMA operates in full compliance with the laws and regulations set forth by the Government of South Africa and the South African Civil Aviation Authority (SACAA).
  2. Any disputes or concerns regarding the application of these laws should be directed to the relevant authorities. BMA is legally obligated to enforce these regulations.
  3. These Terms & Conditions are governed by the laws of the Republic of South Africa, and any disputes will be handled exclusively by South African courts.
  4. All bookings are subject to BMA’s policies and operational requirements.
  5. BMA operates NON-TYPE CERTIFIED AIRCRAFT (NTCA), which do not adhere to the same regulations and standards as type-certified aircraft. Boarding is at your own risk.
  6. Full payment is required before boarding.
  7. All sales are final. No refunds will be issued for cancellations, early termination of a flight, or returns to the airfield after takeoff.
  8. BMA collects and processes personal data solely for service provision and does not share this information.
  9. Your booking covers the flight experience only. BMA is not responsible for any ground transportation, accommodation, or other arrangements, even in the event of flight delays or cancellations.
  10. Group bookings of ten (10) or more people require a 50% deposit. Custom terms may be arranged upon request.
  11. BMA reserves the right to amend these Terms & Conditions at any time without prior notice.

3. BOOKING MODIFICATIONS

  1. Booking changes must be requested via WhatsApp at 082 659 5550 at least 12 hours before the scheduled flight time.
  2. BMA reserves the right to charge a 50% cancellation fee.

4. TIMINGS, DEADLINES, AND MISSED FLIGHTS

  1. Passengers must arrive at least 15 minutes before the scheduled departure time.
  2. Late arrivals may result in BMA rescheduling or reordering flights at its discretion.
  3. If you miss your flight, regardless of the reason, BMA may reschedule or cancel your booking at its discretion.

5. PASSENGER CONDUCT

BMA reserves the right to refuse carriage under the following circumstances:

  1. If your behavior or condition endangers the safety of the aircraft, passengers, or crew.
  2. If you are under the influence of alcohol or narcotics to an extent that compromises safety.
  3. If you are in unlawful possession of drugs.
  4. If your health poses a risk to yourself or others.
  5. If you refuse security checks or disobey safety instructions.
  6. If you engage in abusive, threatening, or disruptive behavior towards staff or passengers.
  7. If you commit a criminal offense during pre-flight procedures.
  8. If your ticket is lost, stolen, altered, counterfeit, or obtained illegally.
  9. If you fail to present a valid booking confirmation.
  10. If you fail to arrive at the boarding area on time.
  11. If you refuse health screenings or required documentation.
  12. If you have previously engaged in misconduct and BMA believes you may repeat such behavior.

Passengers responsible for any fines, damages, or costs incurred due to unlawful actions will be held liable. BMA may permanently ban any passenger who violates safety rules or threatens staff.

6. CHILDREN AND INFANTS

  1. Children are permitted but with parental or guardian consent. Acceptance for carriage is at the pilot’s discretion based on their determination and assessment of child age and size.
  2. A parent or legal guardian must remain at the airfield for the duration of the flight.

7. PASSENGERS NEEDING ASSISTANCE

  1. Passengers requiring special assistance must notify BMA at least 72 hours before departure.
  2. Acceptance for carriage is at the pilot’s discretion and subject to safety assessments.

8. PREGNANCY

  1. Pregnant passengers accept the risks associated with the flights
  2. BMA does not recommend flying beyond 20 weeks of pregnancy.

9. FLIGHT DELAYS AND CHANGES

  1. Flight times are subject to operational and weather-related changes.
  2. BMA is not liable for any losses or damages resulting from flight cancellations or delays.
  3. Microlight flights are highly weather-dependent, and flights may be rescheduled or canceled, even on the day of departure.

10. CANCELLATIONS AND REFUNDS

  1. Flights may be canceled at any time before departure.
  2. A 50% cancellation fee applies to all cancellations by passengers/booking agent.
  3. Changes must be made at least 12 hours in advance.
